General Property Policy

 All property owned, leased, managed, or operated by Cruz Mobile Repair and Cruz Towing Services is private commercial property. Entry onto company property constitutes agreement to comply with all company rules, policies, procedures, safety requirements, and instructions issued by ownership, management, or authorized representatives.

Failure to comply with company policy may result in removal from the property, termination of business relationships, refusal of service, financial liability, towing at owner’s expense, cancellation of contractor privileges, legal action, and/or law enforcement involvement when applicable.

1. Professional Conduct Policy

 All individuals on company property, including employees, contractors, vendors, customers, guests, and visitors, are expected to conduct themselves professionally and respectfully at all times.

The following behavior is prohibited:

  • Threats, intimidation, harassment, or violence
  • Verbal abuse, yelling, or aggressive confrontation
  • Theft or unauthorized removal of property
  • Drug use on property
  • Possession of illegal substances
  • Reckless or unsafe behavior
  • Discrimination or harassment of any kind
  • Tampering with customer vehicles, equipment, tools, or company assets
  • Disorderly conduct that disrupts operations

Management reserves the right to immediately remove any individual from the premises for inappropriate behavior.

2. Safety Policy

 

Safety is mandatory on all company property and job sites.

Required safety expectations include:

  • Following all shop safety procedures
  • Wearing appropriate personal protective equipment (PPE)
  • Maintaining clean and organized work areas
  • Properly storing tools, chemicals, and equipment
  • Reporting unsafe conditions immediately
  • Using equipment only if authorized and trained

The following are prohibited:

  • Horseplay or reckless operation of vehicles/equipment
  • Smoking near flammable materials
  • Unsafe lifting practices
  • Bypassing safety procedures
  • Operating machinery while impaired or fatigued

Any person creating an unsafe condition may be removed from the property immediately.

3. Company Vehicle Use Policy

 All company vehicles, tow trucks, service trucks, trailers, and equipment are company property and may only be operated with authorization from ownership or management.

Operators must:

  • Possess a valid driver’s license
  • Operate vehicles safely and lawfully
  • Immediately report accidents or damage
  • Keep vehicles reasonably clean
  • Perform basic inspections before operation
  • Return vehicles with fuel levels maintained unless otherwise authorized

The following are prohibited:

  • Unauthorized drivers
  • Personal use without authorization
  • Reckless driving
  • Racing, burnouts, or misuse
  • Smoking or drug use in company vehicles
  • Transporting unauthorized passengers
  • Leaving company vehicles unsecured

Any fines, tickets, impound fees, towing fees, damages, fuel abuse, negligence, or losses caused during unauthorized or improper use may become the responsibility of the operator.

4. Overnight Vehicle & Equipment Return Policy

  All company vehicles, tow trucks, trailers, and equipment must be returned to company property no later than 10:00 PM each day unless written or verbal authorization is provided by ownership or management.

Unauthorized overnight possession of company property may result in:

  • Immediate suspension of vehicle privileges
  • Financial penalties
  • Recovery action
  • Police reporting if necessary
  • Termination of contractor or employee relationshipper use may become the responsibility of the operator.

5. Tow Truck & Equipment Borrowing Policy

   Any individual borrowing or operating Cruz Towing Services equipment assumes full responsibility for:

  • Safe operation
  • Fuel usage
  • Mileage
  • Tolls
  • Damages
  • Traffic violations
  • Cleaning
  • Secure loading/unloading
  • Return condition of the equipment

If a vehicle is transported using company equipment:

  • The responsible party must unload the transported vehicle unless otherwise authorized.
  • Failure to unload transported vehicles may result in additional labor fees, storage fees, equipment usage fees, or administrative charges.

Tow truck usage charges may include:

  • Pickup fees
  • Mileage fees
  • Loading/unloading fees
  • Fuel surcharges
  • Storage fees
  • Cleaning fees
  • Damage recovery fees

6. Customer Vehicle Storage Policy

   Vehicles left on company property are subject to storage policies and California lien laws.

Policy includes:

  • No storage fees while under active authorized repair
  • Customers must maintain communication regarding repairs and authorization
  • Once notified that repairs are complete, diagnostics are complete, or authorization is pending, customers have a 5-day grace period
  • Beginning on Day 6, storage fees may accrue at $25 per day or applicable posted rate
  • Vehicles left abandoned may become subject to lien sale procedures under California law

The company is not responsible for:

  • Theft
  • Fire
  • Weather damage
  • Acts of God
  • Loss of personal items left in vehicles

Customers are advised to remove valuables.

7. Payment & Vehicle Release Policy

    Payment is due upon completion of services unless otherwise agreed in writing.

Accepted payment methods may include:

  • Cash
  • Zelle
  • Other approved payment methods authorized by management

The following policies apply:

  • No vehicle, machine, trailer, or equipment will be released until full payment has been received and verified
  • Returned payments, chargebacks, or fraudulent payments may result in legal action
  • Customers disputing valid charges may become responsible for collection costs, storage fees, legal fees, and administrative costs where permitted by law

8. Customer-Supplied Parts Policy

   The company may install customer-supplied parts at management discretion.

However:

  • No warranty is provided on customer-supplied parts
  • Labor associated with defective customer-supplied parts is not refundable
  • Additional labor caused by defective or incorrect parts will be billed accordingly
  • The company reserves the right to refuse installation of low-quality, unsafe, damaged, or incorrect parts

9. Shop Cleanliness & Organization Policy

   The company may install customer-supplied parts at management discretion.

However:

  • No warranty is provided on customer-supplied parts
  • Labor associated with defective customer-supplied parts is not refundable
  • Additional labor caused by defective or incorrect parts will be billed accordingly
  • The company reserves the right to refuse installation of low-quality, unsafe, damaged, or incorrect parts

10. Tool & Equipment Responsibility Policy

 Individuals using company or personal tools/equipment are responsible for:

  • Proper care 
  • Safe operation 
  • Returning tools to designated locations 
  • Reporting damage immediately 

Any person damaging, losing, misusing, or stealing tools/equipment may be held financially responsible.

Unauthorized borrowing of tools or equipment is prohibited.

11. Visitor & Guest Policy

 Visitors are only permitted in authorized areas.

Visitors may not:

  • Interfere with operations 
  • Enter restricted work areas without permission 
  • Operate equipment 
  • Distract mechanics or operators during active work 

Children must remain supervised at all times.

Management may ask any visitor to leave the premises at any time.

12. Surveillance & Security Policy

  Company property may be monitored by video and audio surveillance for:

  • Safety 
  • Security 
  • Theft prevention 
  • Operational review 
  • Legal protection 

Entry onto company property constitutes consent to surveillance monitoring where permitted by law.

13. Drug, Alcohol, & Weapons Policy

  The following are strictly prohibited on company property:

  • Illegal drugs 
  • Alcohol consumption 
  • Impairment while working or operating equipment 
  • Unauthorized firearms or weapons 
  • Possession of controlled substances without lawful authorization 

Any violation may result in immediate removal and possible law enforcement involvement.

14. Environmental & Hazardous Material Policy

 All hazardous materials, fluids, oils, chemicals, batteries, and waste must be handled and disposed of properly in accordance with applicable laws and safety standards.

Improper dumping or disposal is prohibited.

Any spills or environmental hazards must be reported immediately.

15. Confidentiality & Business Information Policy

 Company operations, customer information, pricing structures, vendor relationships, internal procedures, and proprietary business information are confidential.

Unauthorized disclosure or misuse of confidential information may result in termination, legal action, and financial liability.become the responsibility of the operator.

16. Management Rights Policy

   Cruz Mobile Repair and Cruz Towing Services reserve the right to:

  • Refuse service 
  • Remove individuals from the property 
  • Deny access to vehicles or equipment 
  • Modify policies at any time 
  • Enforce all operational and safety requirements 

Failure to comply with company policy may result in suspension of privileges, financial liability, legal enforcement, and/or permanent ban from company property.

Acknowledgment

   

By entering, using, visiting, storing property on, working on, or conducting business with Cruz Mobile Repair and Cruz Towing Services, all individuals acknowledge and agree to comply with these policies and procedures.

These policies may be updated or modified at management discretion without prior notice.
